Terms of Service
These terms help ensure clarity, fairness, and transparency for both parties. They outline expectations, responsibilities, and legal protections that keep our collaboration running smoothly. Payment of an initial deposit indicates agreement to these terms of service.
QUOTES
Quotes are valid for 30 days. If not accepted within this window, EngageTaste reserves the right to revise based on updated project costs, scope, or availability.
ADDITIONAL SCOPE
Clients are responsible for accurately describing the project scope and reviewing all proposals prior to approval. If services are requested or required beyond the approved scope of work, EngageTaste reserves the right to pause work and issue a revised quote. Work will not resume until written approval and payment for the revised scope are received.
Collection Pages
(applies to commerce, blogs, portfolios, events, courses, and video pages)
Unless otherwise arranged, standard quotes include the design of the collection page, the addition of a few representative items, and training on content management. A separate quote will be provided if EngageTaste is to upload all collection content.
PAYMENTS
(for non-99designs projects; 99designs clients follow platform payment terms for billing)
An initial deposit is required to begin work. If a check payment does not clear, the client is in default and subject to a $50 returned check fee. Invoices not paid within 14 days incur a $50 monthly late fee.
Final payment is due upon go-live date, final training, whichever comes first. If neither of those has occurred 30 days after the project's completion, EngageTaste reserves the right to request final payment.
If payment hasn’t been made in 60 days, EngageTaste reserves the right to take the website offline for non-payment. Clients in default agree to pay reasonable attorney fees and third-party collection costs incurred to enforce these terms.
TIMING
To secure a place in the schedule, clients must provide a clear project scope and all finalized content prior to the assigned start date. Project timelines depend on timely communication and submission of materials. Delays may result in the project being rescheduled to the next available opening.
EngageTaste is not liable for delays caused by circumstances beyond its control, including but not limited to natural disasters, illness, power outages, or third-party platform changes. In such cases, EngageTaste will communicate with the client and resume work as soon as reasonably possible.
After 6 months of inactivity, EngageTaste can remove assets from storage to make room for active projects. The project can continue, but assets will need to be reshared.
PROJECT COMPLETION LIMIT
Projects inactive for 90 consecutive days may be deemed complete at EngageTaste's discretion, and any remaining balance will become due. Extensions may be granted with prior written approval.
Should a client wish to re-engage after a period of inactivity, the following policy applies:
6–12 months of inactivity: A re-engagement fee of $200 is required to reactivate the project. The original quote remains valid. Assets will need to be reshared, as storage cannot be guaranteed beyond 6 months.
12 months or more of inactivity: The project must be fully re-quoted at current rates and a new agreement will be issued. Previous payments are retained by EngageTaste as compensation for work completed and time reserved, and are not applied toward the new quote.
Re-engagement fees are non-refundable and cover the time required to review, reassess, and re-orient the project. Work will not resume until the re-engagement fee has been received.
ACCOUNT OWNERSHIP
Ownership of the website transfers to the client upon receipt of final payment. At that time, the client assumes full responsibility for managing login credentials and website maintenance.
Revisions and Scope Boundaries
EngageTaste’s standard package includes two defined revision phases: one for the homepage and one for the remaining pages as a group. Each phase includes up to two consolidated rounds of revisions. All feedback for a given round must be submitted at once in a single written communication. After the second round for that phase, the design is considered final and approved, and the project moves to the next phase.
Once the overall layout, design direction, and content approach have been approved in writing, the included revision phase concludes. If requests arise that exceed the approved scope under either design or content revisions, EngageTaste will assess the additional work and provide a written proposal outlining revised costs and timeline. Work will pause until written approval and payment for the revised scope are received. Depending on the nature of the request, this may be quoted as a small hourly extension to the project.
﹒ SITE DESIGN REVISIONSEngageTaste follows a linear design process to ensure clarity and efficiency. The home page is designed first to establish fonts, colors, visual direction, messaging approach, and overall site flow. Once the home page is approved in writing, the design direction is locked and used to build the remaining pages. Revision requests for the remaining pages are handled as two consolidated rounds across those pages as a whole. Previously approved phases are not reopened under this revision cycle.
This step-by-step structure prevents redundant work and supports an efficient design experience while keeping the project on schedule and within scope. If the client requests a substantial change in direction after design approval, this will be considered a new phase of work and may require a revised agreement and additional payment. Substantial changes include, but are not limited to, shifts in branding, layout structure, visual style, tone, or site flow that diverge from the approved direction.
﹒CONTENT REVISIONS
Content refinements are addressed within the same two revision rounds included in each design phase. Content revisions are limited to refining and placing the content originally provided by the client within the approved site structure and design.
Once the layout, design direction, and messaging approach have been approved in writing, the content revision phase concludes. Additional rounds of refinement, such as repeatedly testing alternate imagery, ongoing copy revisions beyond the originally provided content, or extended decision-making, are not included in the standard scope.
Clients are encouraged to continue refining content, imagery, and messaging after handoff as their business evolves. This is a normal and expected part of maintaining a website.
ASSETS
Clients are responsible for purchasing any required licensed images, fonts, or videos. (View image and video requirements here.) EngageTaste can offer image editing or formatting services for an additional fee. Text must be submitted via email, Google Docs, or Dropbox as an unformatted Word or Docs file.
PROOFING
EngageTaste reviews submitted content for clarity and grammar, but the client holds final responsibility for verifying all information is accurate, up to date, and legally compliant.
Original Content
All content provided by the client must be original or properly licensed. EngageTaste does not knowingly include plagiarized or unauthorized content and reserves the right to reject any materials deemed non-compliant or inappropriate.
Website Accessibility
ADA & Accessibility Awareness
The client acknowledges that website accessibility may be required under the Americans with Disabilities Act (ADA) and/or other applicable state or local laws. Accessibility compliance is an ongoing process and, for many organizations, constitutes the equivalent of a full-time position for a qualified consultant and/or requires the use of specialized accessibility software or plugins. These laws can require that websites be usable by individuals with disabilities, and compliance may help reduce the risk of legal claims.
Designer’s Scope of Work
The designer’s services do not include ADA/WCAG compliance testing, accessibility implementation, continuous monitoring, remediation, or legal compliance verification. Upon request, the designer can recommend accessibility plugins and/or identify potential third-party consultants for the client to engage directly. The designer may, at their discretion, collaborate with such a consultant during the project; however, the client will contract directly with and be responsible for all costs associated with the consultant.
Client Responsibility
The client is solely responsible for determining whether their website is subject to ADA or other accessibility laws and for ensuring ongoing compliance. The client understands that accessibility is an ongoing process, and updates or additions to the site may affect compliance over time.
Disclaimer
No guarantee is made that the website will be fully compliant with all accessibility laws or immune from legal claims. Accessibility regulations and interpretations can change, and compliance efforts should be reviewed regularly.
CODE AND THIRD-PARTY SERVICES
Squarespace and other third-party services may change functionality or policies at any time. EngageTaste is not responsible for compatibility issues resulting from such changes.
Standard web design projects may include one light custom code enhancement at EngageTaste's discretion, when it meaningfully contributes to the design and requires minimal development time. Custom code requests beyond this — including but not limited to complex animations, third-party integrations, or multiple custom elements — are outside standard scope and subject to a separate written proposal and additional payment before work begins.
Custom code is provided as-is. EngageTaste is not responsible for code conflicts arising from future Squarespace updates, third-party plugins, or client modifications made after handoff.
OWNERSHIP & USAGE RIGHTS
Upon full payment, the client owns the final creative deliverables. EngageTaste retains the right to showcase the work in its portfolio unless a confidentiality agreement is signed in advance. Clients are responsible for ensuring they have full rights to any materials provided and agree to indemnify EngageTaste against any resulting claims.
“Designed by EngageTaste”
A discreet “Designed by EngageTaste” credit will be included in the footer of all websites created by EngageTaste. This credit serves as a professional attribution and may assist prospective clients in discovering EngageTaste. Clients are welcome to remove the credit at their discretion, though its inclusion is appreciated.
RIGHTS OF REFUSAL
EngageTaste reserves the right to refuse any work that is illegal, defamatory, obscene, or misaligned with my values.
EARLY TERMINATION & REFUNDS
If the client terminates the project early, partial refunds may be issued for unused time or deliverables at EngageTaste's discretion.
Projects inactive for 12 months or more are not eligible for refunds. Previous payments are retained by EngageTaste as compensation for work completed and time reserved.
Incomplete projects are not eligible for public review. Ownership of any incomplete work remains with EngageTaste unless otherwise agreed.
Re-engagement fees are non-refundable.
Affiliate Disclaimer
EngageTaste participates in affiliate programs with services including Squarespace, SQSP Themes, Peach’s, Ghost Plugins, and others. Any commissions earned are disclosed in accordance with FTC guidelines.
Limitation of Liability
EngageTaste is not liable for any damages, lost profits, or third-party service failures. This includes—but is not limited to—hosting outages, plugin conflicts, and data loss.
INDEMNIFICATION
The client agrees to indemnify and hold harmless EngageTaste and its affiliates from any claims, liabilities, or damages arising from the services provided under this agreement.
GOVERNING LAWS
This agreement is governed by the laws of the State of Missouri. Any disputes will be resolved in St. Louis County and require mediation prior to legal action. All claims must be filed within one year of the issue arising.
Version: May 2026. The Project Completion Limit and Re-Engagement Policy (item 6) and Early Termination & Refunds (item 17) apply to all new projects initiated on or after May 12, 2026. All other terms apply to current and existing projects.
